SmartyXweb Terms of Service (TOS)

Please read these Terms of Service (“Terms”, “Agreement”) carefully before using any services provided by SmartyXweb (“we”, “us”, “our”). By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our services.
1. General Terms
1.1. By purchasing any services from SmartyXweb, you agree to abide by all the terms outlined in this document.
1.2. These Terms are subject to change without prior notice, but changes will be updated on our website. It is your responsibility to check for any updates periodically.
1.3. Violation of these Terms may result in the suspension or termination of your account and services without prior notice.
2. Hosting Services
2.1. Unlimited Packages
Our “Unlimited” hosting packages, including storage, bandwidth, and email, are subject to fair usage policies. These packages are designed for personal, business, and professional website hosting purposes and must not be used for:
- File storage (e.g., for backups, videos, photo galleries not linked to the website, or large data sets)
- Data warehousing (e.g., hosting large quantities of unstructured data or files unrelated to website content)
- Sharing or distributing files not relevant to website operations or not publicly accessible through the website
- Running server-side processes that consume excessive resources (CPU, RAM, etc.)
- Using the server for torrenting, peer-to-peer sharing, or cryptocurrency mining
2.2. Fair Use Limitations
To maintain the performance and security of our servers, SmartyXweb reserves the right to impose the following limits under its fair use policy:
- Storage: Unlimited storage must be related directly to website content. If a website exceeds a storage threshold (such as exceeding 50GB for non-website-related data), SmartyXweb reserves the right to request a review of the usage or impose storage restrictions.
- Bandwidth: Unlimited bandwidth is offered for normal website operations and traffic. Abnormally high usage unrelated to typical website operation may lead to suspension or restriction.
- Email: Unlimited email accounts are provided, but should not be used for spamming or mass email marketing purposes. Excessive email storage (e.g., exceeding 10GB per account) may be subject to review or restriction.
If your account violates these limits, SmartyXweb reserves the right to terminate or suspend services, after which you will be notified of the breach and given the opportunity to comply with fair usage standards.
3. SEO Services
3.1. SEO Strategy and Expectations
Our SEO services aim to improve your website’s search engine ranking and visibility. While we employ industry best practices, SEO results can be influenced by multiple factors, including but not limited to:
- Search engine algorithm changes
- Competitive landscape in your industry
- Quality and consistency of content
- Backlinking strategies from external sites
Therefore, we do not guarantee specific rankings or traffic numbers. The success of our SEO efforts depends on these dynamic factors.
3.2. SmartyXweb Search Engine Guarantee
For specific SEO packages, we offer a Search Engine Guarantee: Rank on the first page for at least one of your targeted keywords within 3 months, or we will continue to work on your site for free until this is achieved. However, this guarantee applies only to keyword phrases mutually agreed upon at the start of the SEO campaign. Changes in keyword selection during the campaign may impact the timeline of results and the guarantee.
3.3. Content and Website Access
For effective SEO service delivery, you must grant SmartyXweb full access to your website and related tools, including but not limited to:
- Content management systems (CMS)
- Analytics and search console access
- Server logs, where applicable
- FTP or control panel access for technical adjustments
Failure to provide the necessary access may affect SEO campaign results and void the Search Engine Guarantee.
3.4. Third-Party Hosting SEO Limitations
If your website is hosted with a third-party provider, SmartyXweb may not be able to provide full SEO services due to access limitations, platform restrictions, or technical incompatibility. In such cases, our SEO results may not be guaranteed, and additional charges may apply for working on non-SMartyXweb hosting platforms.
4. Billing and Payment
4.1. Subscription Plans
All services are billed on a subscription basis (monthly or yearly). Payment is due at the start of each billing cycle. If payment is not received within 14 days of the due date, SmartyXweb reserves the right to suspend or terminate services until payment is made.
4.2. Refunds
We offer a 14-day refund window for hosting services. However, SEO services are non-refundable due to the nature of the work provided.
5. Termination of Service
SmartyXweb reserves the right to terminate or suspend services if you violate these Terms or for any other reason that may jeopardize server integrity, website performance, or service quality for other clients. Prior to termination, you will be notified and given a chance to rectify the situation.
6. Limitation of Liability
SmartyXweb will not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services. This includes, but is not limited to, data loss, loss of revenue, or disruption of service.
7. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any disputes arising out of or in connection with this agreement shall be resolved in the courts of [Insert Jurisdiction].
